Can you sell a house with tenants in California?

Yes. California doesn't require a rental to be empty to sell, and a sale doesn't end the lease. The buyer takes the house subject to it and becomes the tenants' landlord on the same rent, deposit and terms until the lease ends or the tenancy is lawfully ended.

So the question is whether to sell with the tenants in place, wait for the lease to run out, or agree a move-out, and each of those reaches a different set of buyers at a different price.

Is it harder to sell a house with tenants in it?

It narrows the buyer pool and adds steps. Most buyers who want to live in the house can't take one that's occupied, showings run on the tenants' notice, and the buyer will want the lease, rent records and deposit figures before closing. In return you keep collecting rent until the day it sells, and an investor who wants the income doesn't need the house empty. Sacramento metro homes took 45 days to go pending in September 2026, metro-wide and across all buyers; an occupied rental is selling to the investor share of that market.

  1. Start with the lease

The lease end date, notice terms, deposit and any rent-cap exemption notice decide your options: sell with the tenant, wait for the lease to end, or agree a move-out.

“Leases, single-family homes, duplexes, condos, etc. Justin is an excellent agent. He listens to his clients needs.”Investor client for about 13 years, Google review
  2. Price it two ways

What an investor pays for the house with its rent, and what an owner-occupant pays once it is empty, from recent Sacramento sales of both.

“After evaluating the property, Justin stepped me through my options and pricing expectations.”Sold a rental condo, Google review
  3. Work with the tenant, not around them

Written notice of the sale, showings on proper notice, and a plan the tenant hears from you before the sign goes up.

“He dealt with the difficult situation of selling a house that was occupied by tenants. … He respected our tenants and professionally dealt with all involved.”AnneMarie J. on Zillow, 2020
  4. Close with the paperwork in order

The lease, the rent ledger and the security deposit transfer to the buyer at closing, with the notice to the tenant California law requires.

“He kept us frequently updated, moved to a quick close, and promptly responded to questions.”AnneMarie J. on Zillow, sold a tenant-occupied home, 2020

Who buys a Sacramento house with tenants in place

Mostly investors. A buyer who wants to live in the house usually can't buy it occupied, because owner-occupant mortgages expect the buyer to move in soon after closing. That leaves buyers who want the rent: local landlords, out-of-area investors and 1031 exchange buyers looking for a replacement property.

How an investor prices a rental with a tenant

An investor works back from the rent: what the lease brings in, what the house costs to hold, and how long until the rent can move. A rent close to market, a tenant with a good payment record and a clean rent ledger all help. A rent well below market, or a long lease, lowers what that buyer will pay, because they inherit the gap.

Selling the rental to the tenants who live there

Sometimes the best buyer is already in the house. A tenant who can get a mortgage avoids a move, and you avoid showings and vacancy. It's worth asking before you list.

Showing a house with tenants: notice and access in California

California lets you enter to show the house to buyers during normal business hours, with reasonable written notice that gives the date, approximate time and purpose. Twenty-four hours is presumed reasonable (Civil Code 1954(d)(1)). You can't abuse the right of entry or use it to harass the tenants.

Oral showing notice for a tenant-occupied sale

Once you've told the tenants in writing that the house is for sale and that you may contact them orally about showings, you can give notice of each showing in person or by phone for the next 120 days (1954(d)(2)). The 24 hours still applies, and whoever enters must leave written evidence of the entry inside. In practice a schedule the tenants agree to, a few set windows a week, gets better showings than the minimum notice does.

Can you ask tenants to leave because you're selling? AB 1482

Not for the sale itself. Under AB 1482 (Civil Code 1946.2), once tenants have lived in the house 12 months, the tenancy can only end for a just cause stated in the notice, and a sale isn't one. For a no-fault cause you must pay relocation help equal to one month's rent within 15 days of the notice, or waive the final month's rent in writing; get that wrong and the notice is void.

Owner move-in by a buyer under SB 567

A buyer who wants to live there can end the tenancy for owner move-in after closing, with conditions SB 567 tightened from April 1, 2024. For leases made since July 1, 2020, the lease must allow it or the tenants must agree in writing. The buyer has to move in within 90 days after the tenants leave and live there 12 consecutive months; if not, they must offer it back at the same rent and repay reasonable moving costs beyond the relocation money.

AB 1482's single-family exemption for Sacramento rentals

A house that can be sold separately is exempt from AB 1482's just-cause and rent-cap rules only if the owner isn't a REIT, a corporation or an LLC with a corporate member, and the tenants got the exemption notice in the statute's wording, which has to be in the lease for tenancies since July 1, 2020 (1946.2(e)(8), 1947.12(d)(5)). An exempt month-to-month tenancy can end on a 60-day notice, or 30 days in narrower cases, and our guide to the notice to vacate when selling in California covers those, including the 30-day sale rule in 1946.1(d). The full rules are in our AB 1482 guide for Sacramento.

Sacramento's Tenant Protection Program and single-family tenants

Inside city limits, check Sacramento City Code chapter 5.156 too. It exempts single dwelling units, condos and units built after February 1, 1995, so most houses fall outside it, but a duplex or small building from before 1995 can be covered, with its own 120-day notice for owner move-in.

Justin Vierra is a Sacramento native, an East Sacramento resident and Principal of the Vierra Group at GUIDE Real Estate. Before he began selling homes in 2010 he spent six years in Midtown property management: older buildings, multifamily property, maintenance and tenants. That is the side of a rental most sales agents have never stood on, and it shapes how he values and sells one today.

Paying tenants to move out before the sale

When you want the house vacant and the law doesn't give you a way to end the tenancy, the answer is a voluntary agreement: the tenants move out by a date and you pay them to. It's in writing, it's their choice, and the payment has to be worth more to them than staying. How to price and write one is in our cash for keys guide.

Leases, rent and the security deposit when you sell with tenants

At closing the buyer needs the lease, the current rent and what's been paid, and the security deposit. Before a voluntary sale you must give the buyer a written statement of the deposit, any lawful deductions and which of two options you chose (Civil Code 1950.5(j)).

Transferring the tenants' security deposit to the buyer

Option one: transfer what's left after lawful deductions to the buyer, then notify the tenants by personal delivery or first-class mail of the transfer, any claims against it, the amount deposited, and the buyer's names, addresses and phone numbers. Option two: return it to the tenants with an itemized accounting (1950.5(i)). If you do neither, the buyer can be liable for the deposit along with you, so escrow usually credits it to the buyer.

Estoppel certificates for a tenant-occupied sale

Buyers often ask the tenants to sign an estoppel certificate confirming the rent, the lease dates and the deposit held, so there are no surprises after closing. It isn't required by law, but asking for it early avoids a delay at the end.

Justin prices the house both ways, with the tenants and vacant, from recent Sacramento sales, so you can see the difference in dollars before you decide. If you inherited the house with tenants in it, start with selling an inherited rental, and if you're still deciding whether to sell at all, the checklist on whether to sell your rental comes first. Either way, it's the same goal: selling a Sacramento rental for the most it will net you.

Selling a house with tenants in California: common questions

Can a landlord sell a house with tenants in California?

Yes. A sale doesn't end the lease in California: the buyer takes over as landlord on the same terms, and the tenant stays until the lease ends or the tenancy is lawfully ended. Most buyers of an occupied house are investors who price it on the rent, so the rent against market and the lease end date shape the price.

Do tenants have to allow showings when a house is for sale?

California lets a landlord enter to show the house to buyers at reasonable times with reasonable notice. Written notice of 24 hours is presumed reasonable. After you tell the tenant in writing that the house is for sale, you can give notice of individual showings orally for the next 120 days. Agreeing set showing windows with the tenant usually works better than minimum notice.

Can I give my tenant notice because I am selling?

Not on that ground alone. Under AB 1482, once a tenant has lived there 12 months a tenancy can only end for a just cause, and a sale isn't one. If the house is exempt, meaning it isn't owned by a REIT, a corporation or an LLC with a corporate member and the tenant got the statutory exemption notice, a month-to-month tenancy can usually end with 60 days' notice, or 30 if under a year.

Does the new owner have to honor the lease?

Yes. The buyer takes the house subject to the existing lease, on the same rent and terms. A buyer who plans to live there may end the tenancy after closing for owner move-in, but for leases since July 2020 only if the lease allows it or the tenant agrees in writing. They must move in within 90 days, live there 12 months, and pay one month's rent in relocation help or waive the final month.

What happens to the tenant's security deposit when the house sells?

You either transfer what's left after lawful deductions to the buyer and notify the tenant in writing, with the amount, any claims and the buyer's names, addresses and phone numbers, or return it to the tenant with an itemized accounting. Civil Code 1950.5 requires one or the other, and escrow usually credits the deposit to the buyer at closing.

Is it better to sell a rental with tenants or vacant?

Vacant usually reaches more buyers, including people who want to live there, but costs rent while it's empty and may need a move-out agreement to get there. With a tenant in place you keep the rent and sell to investors, who pay for dependable rent near market. The lease end date and how the rent compares with market usually decide it.

How do you avoid capital gains tax when you sell a rental property?

You usually can't avoid it, but you can defer or reduce it. A 1031 exchange into another investment property means you don't recognize the gain now, as long as you follow the IRS rules and take no cash out. Selling costs reduce the gain, and a former home may qualify for part of the section 121 exclusion. Our capital gains and 1031 guides run the numbers; check yours with a CPA.
